H.F. 401 Section 1. Section 272.31, Code 2013, is amended by adding 1 the following new subsection: 2 NEW SUBSECTION . 3A. The board shall issue a classroom 3 driver education instructor authorization for purposes of 4 section 321.178 to a person who completes a training program 5 that meets the standards set by the board, who complies with 6 rules adopted pursuant to subsection 4, and who is either a 7 peace officer as defined in section 801.4, subsection 11, or 8 is retired under chapter 97A or 411, or section 97B.49B or 9 97B.49C, after service as a peace officer as defined in section 10 801.4, subsection 11. The training program shall include 11 but not be limited to a minimum of fifteen contact hours in 12 a program consisting of instruction relating to classroom 13 management, strategies for learning, diversity, and ethics. 14 Sec. 2. Section 321.178, subsection 1, paragraph b, 15 subparagraph (1), Code 2013, is amended to read as follows: 16 (1) To be qualified as a classroom driver education 17 instructor, a person shall have satisfied the educational 18 requirements for a teaching meet one of the following 19 requirements: 20 (a) Hold a valid teacher’s license at the elementary or 21 secondary level and hold a valid license an endorsement to 22 teach driver education in the public schools of this state 23 issued under chapter 272 . 24 (b) Be a peace officer as defined in section 801.4, 25 subsection 11, or, be retired under chapter 97A or 411, or 26 section 97B.49B or 97B.49C, after service as a peace officer 27 as defined in section 801.4, subsection 11, and meet the 28 requirements of section 272.31, subsection 3A. 29 EXPLANATION 30 This bill permits a person who is a peace officer or a 31 retired peace officer to be qualified as a classroom driver 32 education instructor if the person also meets the board of 33 educational examiner’s requirements for a classroom driver 34 education instructor authorization. H.F. 401 holding a teaching license with an endorsement to teach driver 1 education may qualify to be a classroom driver education 2 instructor. 3 The bill directs the board of educational examiners to 4 issue a classroom driver education instructor authorization 5 to a person who completes a training program that meets the 6 standards set by the board and who is either a peace officer or 7 a retired peace officer. The training program shall include 8 but not be limited to a minimum of 15 contact hours in a program 9 consisting of instruction relating to classroom management, 10 strategies for learning, diversity, and ethics. 11 The term “peace officer” is currently defined in Code 12 section 801.4, subsection 11, to include sheriffs, deputy 13 sheriffs, marshals and police officers of cities, peace officer 14 members of the department of public safety, parole officers, 15 probation officers, special security officers employed by 16 regents institutions, conservation officers, employees of 17 the department of transportation or of an aviation authority 18 designated as “peace officers”, and such persons as may be 19 otherwise so designated by law. 20 -2- LSB 1975YH (3) 85 kh/nh 2/ 2
