H.F. 236 Section 1. Section 321.247, Code 2013, is amended to read 1 as follows: 2 321.247 Golf cart operation on city streets . 3 1. a. Incorporated areas may, upon approval of their The 4 governing body , of an incorporated area may allow the operation 5 of golf carts on city streets by persons possessing a valid 6 driver’s license. However, a person shall not operate a golf 7 cart shall not be operated upon a city street which is a 8 primary road extension through the city but shall be allowed to 9 except to cross a city street which is a primary road extension 10 through the city. 11 b. (1) A county board of supervisors may allow the 12 operation of golf carts on the streets of an established 13 community within the unincorporated area of the county by 14 persons possessing a valid driver’s license. However, a person 15 shall not operate a golf cart upon a primary road within an 16 unincorporated area except to cross a section of a primary road 17 which lies within an established community in which golf cart 18 operation is permitted. 19 (2) For purposes of this lettered paragraph “b” , 20 “established community” means an area designated by the county 21 board of supervisors which is the same or substantially the 22 same as an area identified by the United States census bureau 23 as a census designated place as of the most recent decennial 24 census. 25 c. The operation of golf carts pursuant to paragraph “a” or 26 “b” is only allowed between sunrise and sunset. 27 b. d. The golf carts A golf cart operated on streets 28 pursuant to paragraph “a” or “b” shall be equipped with a slow 29 moving vehicle sign , and a bicycle safety flag , and operate on 30 the streets only from sunrise to sunset. 31 c. Golf carts operated on city streets shall be equipped 32 with adequate brakes and shall meet any other safety 33 requirements imposed by the governing body or the board . 34 2. A person who violates subsection 1 commits a simple 2 misdemeanor punishable as a scheduled violation under section 3 805.8A, subsection 3 . 4 EXPLANATION 5 Under current law, golf carts may be operated on certain city 6 streets if approved by the governing body of the incorporated 7 area. Golf carts may not be operated on a primary road 8 extension within the city except to cross the primary road 9 extension, and golf cart operation is only allowed from sunrise 10 to sunset. The person operating the golf cart must have a 11 valid driver’s license and the golf cart must be equipped with 12 a slow moving vehicle sign, a bicycle safety flag, and adequate 13 brakes. The governing body may impose additional safety 14 requirements. 15 This bill allows a county board of supervisors to allow 16 the operation of golf carts on the streets of an established 17 community within an unincorporated area. The bill defines 18 “established community” to mean an area designated by the 19 board of supervisors which is the same or substantially the 20 same as an area identified by the United States census bureau 21 as a census designated place as of the most recent decennial 22 census. Census designated places are statistical counterparts 23 of incorporated places and contain settled concentrations of 24 population which are identifiable by name. Under the bill, 25 golf cart operation in an established community within an 26 unincorporated area is subject to the same licensing and safety 27 equipment requirements currently applicable to the operation of 28 golf carts in cities. Golf carts are not permitted on primary 29 roads within an unincorporated area, except to cross a segment 30 of a primary road located within the established community 31 where golf cart operation is allowed. The bill specifies that 32 in cities and unincorporated areas where golf cart operation is 33 allowed, it may only take place between sunrise and sunset. 34 A person who violates provisions relating to the operation 35 -2- LSB 1053HV (1) 85 dea/nh 2/ 3
