H.F. 2206 Section 1. NEW SECTION . 901C.1 Removal of charge records 1 from the Iowa court information system. 2 When a person is found not guilty of a charge or when a 3 charge is dismissed against a person, except as provided in 4 section 907.4, the state court administrator shall cause 5 the records of the charge to be removed from the Iowa court 6 information system so that the charge records are not available 7 to the general public. 8 Sec. 2. Section 907.9, subsection 4, paragraph c, 9 unnumbered paragraph 1, Code 2014, is amended to read as 10 follows: 11 A Except as provided in section 901C.1, a dismissed count or 12 related charge shall be expunged pursuant to the provisions of 13 paragraph “b” in the following manner: 14 EXPLANATION 15 The inclusion of this explanation does not constitute agreement with 16 the explanation’s substance by the members of the general assembly. 17 This bill relates to removal of charge records from the Iowa 18 court information system. 19 The bill directs the state court administrator to remove 20 charge records from the Iowa court information system that 21 is available to the general public, if a person is found not 22 guilty of that charge or that charge is dismissed against the 23 person. 24 -1- LSB 5638YH (5) 85 jm/rj 1/ 1
