H.F. 2107 Section 1. Section 35.1, subsection 2, paragraph b, 1 subparagraphs (1) and (2), Code 2014, are amended to read as 2 follows: 3 (1) Former members of the reserve forces of the United 4 States who served at least twenty years in the reserve forces 5 and who were discharged under honorable conditions. However, a 6 member of the reserve forces of the United States who completed 7 a minimum aggregate of ninety days of served on federal active 8 duty, other than training, and was discharged under honorable 9 conditions, or was retired under Tit. 10 of the United States 10 Code shall be included as a veteran. 11 (2) Former members of the Iowa national guard who served 12 at least twenty years in the Iowa national guard and who were 13 discharged under honorable conditions. However, a member of 14 the Iowa national guard who was activated for served on state 15 active duty or federal active duty, other than training , for 16 a minimum aggregate of ninety days, and was discharged under 17 honorable conditions or was retired under Tit. 10 of the United 18 States Code shall be included as a veteran. 19 EXPLANATION 20 The inclusion of this explanation does not constitute agreement with 21 the explanation’s substance by the members of the general assembly. 22 This bill relates to veterans affairs by expanding the 23 definition of veteran in Code section 35.1. 24 Under current law the term veteran includes former members 25 of the reserve forces of the United States who served at least 26 20 years in the reserve forces and who were discharged under 27 honorable conditions and members of the reserve forces who 28 completed a minimum aggregate of 90 days of federal active 29 duty, other than training, and were discharged under honorable 30 conditions, or retired under Title 10 of the United States 31 Code. 32 The term also includes former members of the Iowa national 33 guard who served at least 20 years in the Iowa national guard 34 and who were discharged under honorable conditions and members 35 -1- LSB 5627HH (2) 85 aw/nh 1/ 2
H.F. 2107 of the Iowa national guard who were activated for federal duty, 1 other than training, for a minimum aggregate of 90 days, and 2 were discharged under honorable conditions or were retired 3 under Title 10 of the United States Code. 4 The bill maintains current law for former members who served 5 at least 20 years, but provides that any member of the reserve 6 forces of the United States who served on federal active duty, 7 other than training, and any Iowa national guard member who 8 served on state or federal active duty, other than training, 9 who was discharged under honorable conditions or was retired 10 under Title 10 of the United States Code shall be included as 11 a veteran. 12 The definition of veteran in Code section 35.1 is cited 13 elsewhere throughout the Code, including in provisions related 14 to veterans benefits, employment, education, property taxes, 15 and insurance. 16 -2- LSB 5627HH (2) 85 aw/nh 2/ 2
