H.F. 2068 Section 1. Section 257.8, subsections 1 and 2, Code 2014, 1 are amended to read as follows: 2 1. State percent of growth. The state percent of growth 3 for the budget year beginning July 1, 2012, is two percent. 4 The state percent of growth for the budget year beginning July 5 1, 2013, is two percent. The state percent of growth for the 6 budget year beginning July 1, 2014, is four percent. The state 7 percent of growth for each subsequent budget year shall be 8 established by statute which shall be enacted within thirty 9 days of the submission in the year preceding the base year of 10 the governor’s budget under section 8.21 . The establishment 11 of the state percent of growth for a budget year shall be the 12 only subject matter of the bill which enacts the state percent 13 of growth for a budget year. If the statute establishing the 14 state percent of growth for a budget year is not enacted within 15 thirty days of the submission in the year preceding the base 16 year of the governor’s budget under section 8.21, the director 17 of the department of management shall set the state percent of 18 growth for that budget year at a percent equal to the percent 19 increase in the total amount of general fund revenues collected 20 during the most recently completed fiscal year as compared to 21 the total amount of general fund revenues collected during the 22 fiscal year preceding the most recently completed fiscal year, 23 as certified by the revenue estimating conference during its 24 final meeting of the previous calendar year. 25 2. Categorical state percent of growth. The categorical 26 state percent of growth for the budget year beginning July 27 1, 2012, is two percent. The categorical state percent of 28 growth for the budget year beginning July 1, 2013, is two 29 percent. The categorical state percent of growth for the 30 budget year beginning July 1, 2014, is four percent. The 31 categorical state percent of growth for each budget year shall 32 be established by statute which shall be enacted within thirty 33 days of the submission in the year preceding the base year of 34 the governor’s budget under section 8.21 . H.F. 2068 of the categorical state percent of growth for a budget year 1 shall be the only subject matter of the bill which enacts the 2 categorical state percent of growth for a budget year. The 3 categorical state percent of growth may include state percents 4 of growth for the teacher salary supplement, the professional 5 development supplement, the early intervention supplement, and 6 the teacher leadership supplement. If the statute establishing 7 the categorical state percent of growth for a budget year 8 is not enacted within thirty days of the submission in the 9 year preceding the base year of the governor’s budget under 10 section 8.21, the director of the department of management 11 shall set the categorical state percent of growth for that 12 budget year at a percent equal to the percent increase in the 13 total amount of general fund revenues collected during the most 14 recently completed fiscal year as compared to the total amount 15 of general fund revenues collected during the fiscal year 16 preceding the most recently completed fiscal year, as certified 17 by the revenue estimating conference during its final meeting 18 of the previous calendar year. 19 Sec. 2. EFFECTIVE UPON ENACTMENT. This Act, being deemed of 20 immediate importance, takes effect upon enactment. 21 Sec. 3. APPLICABILITY. This Act applies to the 22 establishment of the state percent of growth and the 23 categorical state percent of growth for school budget years 24 beginning on or after July 1, 2015. 25 EXPLANATION 26 The inclusion of this explanation does not constitute agreement with 27 the explanation’s substance by the members of the general assembly. 28 Current Code section 257.8 requires the statute establishing 29 the state percent of growth and the statute establishing the 30 categorical state percent of growth to each be enacted within 31 30 days of the submission in the year preceding the base year 32 of the governor’s budget. This bill provides that if for a 33 budget year a statute establishing the state percent of growth 34 is not enacted within such 30-day period, the state percent of 35 -2- LSB 5354YH (4) 85 md/sc 2/ 3
H.F. 2068 growth established for that budget year shall be equal to the 1 percent increase in the total amount of general fund revenues 2 collected during the most recently completed fiscal year as 3 compared to the total amount of general fund revenues collected 4 during the fiscal year preceding the most recently completed 5 fiscal year, as certified by the revenue estimating conference 6 during its final meeting of the previous calendar year. 7 The bill further provides that if for a budget year a 8 statute establishing a categorical state percent of growth is 9 not enacted within such 30-day period, the categorical state 10 percent of growth established for that budget year shall be 11 equal to the percent increase in the total amount of general 12 fund revenues collected during the most recently completed 13 fiscal year as compared to the total amount of general fund 14 revenues collected during the fiscal year preceding the most 15 recently completed fiscal year, as certified by the revenue 16 estimating conference during its final meeting of the previous 17 calendar year. 18 The bill takes effect upon enactment. The bill applies 19 to the establishment of the state percent of growth and the 20 categorical state percent of growth for school budget years 21 beginning on or after July 1, 2015. 22 -3- LSB 5354YH (4) 85 md/sc 3/ 3
