There
is
appropriated
from
the
general
fund
of
the

state
to
the
department
of
human
services
for
the
fiscal
year

beginning
July
1,
2012,
and
ending
June
30,
2013,
the
following

amount,
or
so
much
thereof
as
is
necessary,
to
be
used
for
the

purposes
designated:

Notwithstanding
section
8.33,
moneys
appropriated
in
this

subsection
that
remain
unencumbered
or
unobligated
at
the
close

of
the
fiscal
year
shall
not
revert
but
shall
remain
available

for
expenditure
for
the
purposes
designated
until
the
close
of
15
the
succeeding
fiscal
year.

a.
The
moneys
credited
to
the
mental
health
and
17
disability
services
redesign
transition
fund
pursuant
to
18
subsection
1
are
appropriated
to
the
department
of
human
19
services
for
allocation
as
provided
in
this
lettered
paragraph.

The
moneys
shall
be
allocated
to
those
counties
identified
by
21
the
department
in
scenario
1
of
the
department’s
report
on
the
22
transition
fund
submitted
to
the
general
assembly
on
December
23
4,
2012,
pursuant
to
2012
Iowa
Acts,
chapter
1120,
section
24
23,
to
be
used
to
continue
or
restore
services
as
provided
25
in
the
county
applications
in
the
award
amounts
determined
26
by
the
department
and
listed
under
scenario
1
in
the
report
27
appendix.
In
addition,
the
moneys
shall
be
allocated
to
the
28
identified
counties
and
to
the
other
counties
that
applied
for
29
the
transition
fund,
in
the
amounts
necessary
for
the
counties
30
to
carry
forward
from
the
fiscal
year
beginning
July
1,
2012,
31
to
the
succeeding
fiscal
year,
an
ending
balance
of
not
less
32
than
16.87
percent
nor
more
than
25
percent
of
the
amount
each
33
of
the
counties
levied
for
the
services
fund
created
in
section

331.424A
for
the
current
fiscal
year.

The
allocations
under
this
subsection
shall
be
remitted
1
to
counties
not
later
than
two
calendar
weeks
following
the
2
effective
date
of
this
division
of
this
Act.

c.
A
county
receiving
an
allocation
under
this
subsection
4
shall
either
pay
its
obligation
for
outstanding
Medicaid
5
billings
to
the
state
before
the
close
of
the
fiscal
year
6
beginning
July
1,
2012,
or
have
developed
a
plan
with
the
7
department
for
payment
of
the
obligation
over
a
defined
period
8
of
time.

Sec.
2.
EFFECTIVE
UPON
ENACTMENT.
This
Act,
being
deemed
of
10
immediate
importance,
takes
effect
upon
enactment.

EXPLANATION
12
This
bill
relates
to
mental
health
and
disability
services
13
(MH/DS)
by
making
supplemental
appropriations
for
the
fiscal
14
year
beginning
July
1,
2012.

An
appropriation
is
made
from
the
general
fund
of
the
16
state
to
the
department
of
human
services
to
be
credited
17
to
the
MH/DS
redesign
transition
fund
created
in
2012
Iowa
18
Acts,
chapter
1120
(S.F.
2315).
The
moneys
are
appropriated
19
from
the
transition
fund
to
the
department
for
allocation
to
20
counties
as
provided
in
the
bill.
The
moneys
are
allocated
21
to
those
counties
that
applied
for
transition
fund
assistance
22
and
were
designated
for
an
award
amount
in
scenario
1
of
23
the
department’s
report
to
the
general
assembly
submitted
on
24
December
4,
2012,
pursuant
to
S.F.
2315,
and
to
those
counties
25
that
applied
for
transition
fund
assistance
but
were
not
26
designated
for
an
award
in
the
department’s
report.
The
amount
27
to
be
remitted
to
each
county
is
the
award
amount
determined
28
by
the
department
plus
the
amount
necessary
for
the
county
to
29
carry
forward
from
the
fiscal
year
beginning
July
1,
2012,
to
30
the
succeeding
fiscal
year,
an
ending
balance
of
not
less
than
31
16.87
percent
nor
more
than

percent
of
the
amount
the
county
