Section 321I.1, subsection 1, paragraph a, Code 1 2011, is amended to read as follows: 2 a. “All-terrain vehicle” means a motorized flotation-tire 3 vehicle with not less than three and not more than six 4 low-pressure nonhighway tires that has a width not exceeding 5 fifty inches and is limited in engine displacement to less than 6 one thousand cubic centimeters and in total dry weight to less 7 than one thousand two hundred pounds and that has a seat or 8 saddle designed to be straddled by the operator and handlebars 9 for steering control . 10 Sec. 2. Section 321I.1, subsection 16, paragraph a, Code 11 2011, is amended to read as follows: 12 a. “Off-road utility vehicle” means a motorized 13 flotation-tire vehicle with not less than four and not more 14 than eight low-pressure nonhighway tires that has a width 15 not exceeding sixty-five inches and is limited in engine 16 displacement to less than one thousand five hundred cubic 17 centimeters and in total dry weight to not more than one two 18 thousand eight hundred pounds and that has a seat that is of 19 bucket or bench design, not intended to be straddled by the 20 operator, and a steering wheel or control levers for control . 21 EXPLANATION 22 This bill revises the definitions of “all-terrain vehicle” 23 and “off-road utility vehicle” for purposes of Code chapter 24 321I. 25 The definition of “all-terrain vehicle” is amended to 26 include vehicles with not less than three and not more than 27 six nonhighway tires. In addition, the revised definition 28 limits the width of all-terrain vehicles to not more than 50 29 inches, limits the engine displacement to less than 1,000 cubic 30 centimeters, limits the dry weight to less than 1,200 pounds, 31 and omits current requirements for a seat or saddle designed 32 to be straddled by the operator and handlebars for steering 33 control. 34 The definition of “off-road utility vehicle” is amended to 35 -1- LSB 5443SC (2) 84 dea/nh 1/ 2
