1.
Section
458A.2,
Code
2011,
is
amended
by
adding
1
the
following
new
subsection:

NEW
SUBSECTION
.
7A.
“Hydraulic
fracturing”
or
“fracking”

means
the
extraction
of
oil
or
gas
pursuant
to
the
propagation
4
of
fractures
in
the
earth’s
surface
through
the
injection
of
a
5
pressurized
fluid
to
increase
extraction
rates.

1.
The
director
shall
not
issue
a
permit
pursuant
to
section
9
458A.5
for
the
drilling
of
a
well
for
oil
or
gas
utilizing
10
hydraulic
fracturing
until
one
hundred
eighty
days
after
11
submission
by
an
applicant
to
the
department
of
all
of
the
12
following:
13
a.
Notice
of
the
applicant’s
intent
to
drill
utilizing
14
hydraulic
fracturing.
15
b.
The
anticipated
drilling
commencement
date.
16
c.
A
list
of
all
chemicals
and
other
substances
to
be
17
injected
underground.
18
d.
Certification
that
none
of
the
chemicals
to
be
used
19
causes
or
induces
cancer
or
poses
any
other
threat
to
human
20
health
if
ingested,
inhaled,
or
contacted
with
the
skin.

The
department
shall
adopt
rules
specifying
verification
22
procedures
regarding
the
certification
submitted,
and
providing
23
for
posting
of
the
list
and
certification
on
an
internet
site
24
maintained
by
the
department.

EXPLANATION
26
This
bill
specifies
requirements
applicable
to
the
issuance
27
of
a
permit
for
extraction
of
oil
or
natural
gas
pursuant
to
28
hydraulic
fracturing.
29
The
bill
defines
“hydraulic
fracturing”
to
mean
the
30
extraction
of
oil
or
gas
pursuant
to
the
propagation
of
31
fractures
in
the
earth’s
surface
through
the
injection
of
a
32
pressurized
fluid
to
increase
extraction
rates.
The
bill
33
provides
that
the
director
of
the
department
of
natural
34
resources
shall
not
issue
a
drilling
permit
pursuant
to
Code
35

the
drilling
of
a
well
for
oil
or

utilizing
hydraulic
fracturing
until
180
days
after
submission

by
an
applicant
to
the
department
of
natural
resources
of

specified
information.
The
applicant
is
required
to
submit
4
notice
of
the
intent
to
drill
utilizing
hydraulic
fracturing,
5
the
anticipated
drilling
commencement
date,
a
list
of
all
6
chemicals
and
other
substances
to
be
injected
underground,
and
7
certification
that
none
of
the
chemicals
to
be
used
causes
or
8
induces
cancer
or
poses
any
other
threat
to
human
health
if
9
ingested,
inhaled,
or
contacted
with
the
skin.
10
The
bill
directs
the
department
to
adopt
rules
specifying

verification
procedures
regarding
the
