S.F. 143 Section 1. Section 15F.204, Code 2011, is amended by adding 1 the following new subsection: 2 NEW SUBSECTION . 10. If an application for financial 3 assistance under the program has been approved by the board 4 pursuant to section 15F.203 but the moneys have not been 5 disbursed by the treasurer of state, those moneys shall be 6 deemed obligated and encumbered. A failure to timely disburse 7 such moneys shall constitute a breach of contract by the state. 8 Sec. 2. EFFECTIVE UPON ENACTMENT. This Act, being deemed of 9 immediate importance, takes effect upon enactment. 10 EXPLANATION 11 This bill provides that applications for financial 12 assistance under the community attraction and tourism program 13 that have been approved by the vision Iowa board constitute 14 obligated and encumbered moneys and that the treasurer of state 15 must disburse such moneys or be in breach of contract. 16 The bill takes effect upon enactment. 17 -1- LSB 1797XS (2) 84 tw/sc 1/ 1
