S.F. 111 Section 1. Section 514I.1, subsection 5, Code 2011, is 1 amended by striking the subsection. 2 Sec. 2. Section 514I.4, subsection 5, paragraph b, Code 3 2011, is amended by striking the paragraph. 4 Sec. 3. Section 514I.5, subsection 8, paragraph h, Code 5 2011, is amended by striking the paragraph. 6 Sec. 4. Section 514I.7, subsection 2, paragraph l, Code 7 2011, is amended by striking the paragraph. 8 Sec. 5. Section 514I.8, subsection 2, paragraph c, Code 9 2011, is amended to read as follows: 10 c. Is a member of a family whose income does not exceed 11 three one hundred fifty percent of the federal poverty level, 12 as defined in 42 U.S.C. § 9902(2), including any revision 13 required by such section, and in accordance with the federal 14 Children’s Health Insurance Program Reauthorization Act of 15 2009, Pub. L. No. 111-3. 16 Sec. 6. Section 514I.8, subsection 3, Code 2011, is amended 17 to read as follows: 18 3. In accordance with the rules adopted by the board, 19 a child may be determined to be presumptively eligible for 20 the program pending a final eligibility determination. 21 Following final determination of eligibility by the 22 administrative contractor, a child shall be eligible for a 23 twelve-month period. At the end of the twelve-month period, 24 the administrative contractor shall conduct a review of the 25 circumstances of the eligible child’s family to establish 26 eligibility and cost sharing for the subsequent twelve-month 27 period. 28 Sec. 7. Section 514I.10, subsections 2 and 3, Code 2011, are 29 amended by striking the subsections. 30 Sec. 8. DIRECTIVE TO DEPARTMENT OF HUMAN SERVICES. The 31 department of human services shall amend the children’s 32 health insurance program state plan to provide for coverage of 33 children whose family income does not exceed one hundred fifty 34 percent of the federal poverty level beginning July 1, 2011. 35 -1- LSB 1854SS (4) 84 pf/nh 1/ 2
S.F. 111 Sec. 9. EFFECTIVE UPON ENACTMENT. The following provision 1 of this Act, being deemed of immediate importance, takes effect 2 upon enactment: 3 1. The section of this Act directing the department of human 4 services to amend the children’s health insurance program state 5 plan. 6 EXPLANATION 7 This bill amends provisions relating to the healthy and 8 well kids in Iowa program to reduce income eligibility for the 9 program from 300 percent of the federal poverty level to not 10 more than 150 percent of the federal poverty level. The bill 11 directs the department of human services (DHS) to amend the 12 children’s health insurance program state plan to provide for 13 coverage of children whose family income does not exceed 150 14 percent of the federal poverty level beginning July 1, 2011. 15 The provision directing DHS to amend the children’s health 16 insurance program state plan takes effect upon enactment. 17 -2- LSB 1854SS (4) 84 pf/nh 2/ 2
