H.F. 2048 Section 1. NEW SECTION . 321.5A Automated traffic law 1 enforcement systems prohibited. 2 1. The department or a local authority shall not place 3 or cause to be placed on or adjacent to a street or highway, 4 or maintain or employ the use of, an automated traffic law 5 enforcement system for the enforcement of any provision of this 6 chapter or any local ordinance relating to vehicular traffic or 7 to prove a violation of any such provision or ordinance. 8 2. For purposes of this section, “automated traffic law 9 enforcement system” means a device with one or more sensors 10 working in conjunction with a traffic control signal or device 11 or a speed-measuring device to produce recorded images of 12 vehicles being operated in violation of traffic or speed laws. 13 Sec. 2. TERMINATION OF AUTOMATED TRAFFIC LAW ENFORCEMENT 14 PROGRAMS —— REMOVAL OF SYSTEMS —— VALIDITY OF PRIOR NOTICES AND 15 CITATIONS. 16 1. A local authority using an automated traffic law 17 enforcement system shall discontinue using the system on or 18 before the effective date of this Act. A local authority shall 19 remove all automated traffic law enforcement system equipment 20 from the highways on or before July 1, 2012. 21 2. As of the effective date of this Act, all local 22 ordinances authorizing the use of an automated traffic law 23 enforcement system are void. However, notices of violations 24 mailed or citations issued pursuant to such an ordinance 25 prior to the date the ordinance becomes void shall not be 26 invalidated under this Act and shall be processed according to 27 the provisions of the law under which they were authorized. 28 Sec. 3. EFFECTIVE UPON ENACTMENT. This Act, being deemed of 29 immediate importance, takes effect upon enactment. 30 EXPLANATION 31 This bill prohibits the use of automated traffic law 32 enforcement systems in Iowa. 33 Automated traffic law enforcement systems, commonly known 34 as “red light cameras” or “speed cameras”, are devices with 35 -1- LSB 5038YH (3) 84 dea/nh 1/ 2
H.F. 2048 one or more sensors which work in conjunction with a traffic 1 control signal or device or a speed-measuring device to produce 2 recorded images of vehicles being operated in violation of 3 traffic or speed laws. 4 The bill requires that a local authority currently using 5 an automated traffic law enforcement system shall discontinue 6 using the system on or before the effective date of the bill. 7 All automated traffic law enforcement system equipment must be 8 removed from the highways by July 1, 2012. 9 A local authority’s ordinance authorizing the use of 10 automated traffic law enforcement systems is void on the 11 effective date of the bill, but notices of violations mailed 12 or citations issued under such an ordinance shall not be 13 invalidated and shall be processed according to the prior law. 14 The bill is effective upon enactment. 15 -2- LSB 5038YH (3) 84 dea/nh 2/ 2
