GOALS AND ACCOUNTABILITY —— ECONOMIC DEVELOPMENT. 7 1. For the fiscal year beginning July 1, 2010, the goals for 8 the department of economic development shall be to expand and 9 stimulate the state economy, increase the wealth of Iowans, and 10 increase the population of the state. 11 2. To achieve the goals in subsection 1, the department 12 of economic development shall do all of the following for the 13 fiscal year beginning July 1, 2010: 14 a. Concentrate its efforts on programs and activities that 15 result in commercially viable products and services. 16 b. Adopt practices and services consistent with free 17 market, private sector philosophies. 18 c. Ensure economic growth and development throughout the 19 state. 20 Sec. 3. DEPARTMENT OF ECONOMIC DEVELOPMENT. There is 21 appropriated from the general fund of the state to the 22 department of economic development for the fiscal year 23 beginning July 1, 2010, and ending June 30, 2011, the following 24 amounts, or so much thereof as is necessary, to be used for the 25 purposes designated: 26 1. The administration division shall coordinate with 3 other state agencies to ensure that all state departments are 4 attentive to the needs of an entrepreneurial culture. 5 c. Full-time equivalent positions authorized under this 6 subsection shall be funded, in full or in part, using moneys 7 appropriated under this subsection and subsections 2 and 3 8 and by certain federal moneys or other moneys received by the 9 department. 10 d. Notwithstanding section 8.33, moneys appropriated in 11 this subsection that remain unencumbered or unobligated at the 12 close of the fiscal year shall not revert but shall remain 13 available for expenditure for the purposes designated until the 14 close of the succeeding fiscal year. 15 2. BUSINESS DEVELOPMENT DIVISION 16 a. For business development operations and programs, the 17 film office, international trade, export assistance, workforce 18 recruitment, and the partner state program; for transfer to the 19 strategic investment fund; for transfer to the grow Iowa values 20 fund; and for the support of the business development division: 21 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 5,346,536 22 b. The department shall establish a strong and aggressive 23 marketing image to showcase Iowa’s workforce, existing 24 industry, and potential. A priority shall be placed on 25 recruiting new businesses, business expansion, and retaining 26 existing Iowa businesses. Emphasis shall also be placed on 27 entrepreneurial development through helping to secure capital 28 for entrepreneurs, and developing networks and a business 29 climate conducive to entrepreneurs and small business. 30 c. A business creating jobs with economic development 31 assistance through moneys appropriated in this subsection shall 32 be subject to contract provisions stating that new and retained 33 jobs shall be filled by individuals who are citizens of the 34 United States who reside within the United States or any person 35 -3- LSB 5089JB (2) 83 tw/tm 3/ 16
S.F. _____ H.F. _____ authorized to work in the United States pursuant to federal 1 law, including legal resident aliens in the United States. Any 2 vendor who receives such public moneys shall adhere to such 3 contract provisions and provide periodic assurances as the 4 state shall require that the jobs are filled solely by citizens 5 of the United States who reside within the United States or 6 any person authorized to work in the United States pursuant 7 to federal law, including legal resident aliens in the United 8 States. A business that receives financial assistance from 9 the department from moneys appropriated in this bill shall 10 only employ individuals legally authorized to work in this 11 state. In addition to all other applicable penalties provided 12 by current law, all or a portion of the assistance received 13 by a business which is found to knowingly employ individuals 14 not legally authorized to work in this state is subject to 15 recapture by the department. 16 d. From the moneys appropriated in this subsection, the 17 department may provide financial assistance in the form of a 18 grant to a community economic development entity for conducting 19 a local workforce recruitment effort designed to recruit former 20 citizens of the state and former students at colleges and 21 universities in the state to meet the needs of local employers. 22 e. From the moneys appropriated in this subsection, the 23 department may provide financial assistance to early-stage 24 industry companies being established by women entrepreneurs. 25 f. From the moneys appropriated in this subsection, the 26 department may provide financial assistance in the form of 27 grants, loans, or forgivable loans for advanced research and 28 commercialization projects involving value-added agriculture, 29 advanced technology, or biotechnology. 30 g. Notwithstanding section 8.33, moneys appropriated in 31 this subsection that remain unencumbered or unobligated at the 32 close of the fiscal year shall not revert but shall remain 33 available for expenditure for the purposes designated until the 34 close of the succeeding fiscal year. 35 -4- LSB 5089JB (2) 83 tw/tm 4/ 16

For support, maintenance, miscellaneous purposes, 2 community economic development programs, tourism operations, 3 community assistance, plans for Iowa green corps and summer 4 youth programs, the mainstreet and rural mainstreet programs, 5 the school-to-career program, the community development block 6 grant, and housing and shelter-related programs: 7 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 5,063,917 8 b. The department shall encourage development of 9 communities and quality of life to foster economic growth. The 10 department shall prepare communities for future growth and 11 development through development, expansion, and modernization 12 of infrastructure. 13 c. The department shall develop public-private partnerships 14 with Iowa businesses in the tourism industry, Iowa tour groups, 15 Iowa tourism organizations, and political subdivisions in this 16 state to assist in the development of advertising efforts. 17 The department shall, to the fullest extent possible, develop 18 cooperative efforts for advertising with contributions from 19 other sources. 20 d. Notwithstanding section 8.33, moneys appropriated in 21 this subsection that remain unencumbered or unobligated at the 22 close of the fiscal year shall not revert to any fund but shall 23 remain available for expenditure for the designated purposes 24 during the succeeding fiscal year. 25 4. VISION IOWA PROGRAM —— FTE AUTHORIZATION. For 14 purposes of administrative duties associated with the vision 15 Iowa program, the department of economic development is 16 authorized an additional 2.25 FTEs above those otherwise 17 authorized in this Act. 18 Sec. 5. INSURANCE ECONOMIC DEVELOPMENT. From the moneys 19 collected by the division of insurance in excess of the 20 anticipated gross revenues under section 505.7, subsection 3, 21 during the fiscal year beginning July 1, 2010, $100,000 shall 22 be transferred to the department of economic development for 23 insurance economic development and international insurance 24 economic development. 25 Sec. 6. COMMUNITY DEVELOPMENT LOAN FUND. Notwithstanding 26 section 15E.120, subsection 5, there is appropriated from the 27 Iowa community development loan fund all the moneys available 28 during the fiscal year beginning July 1, 2010, and ending June 29 30, 2011, to the department of economic development for the 30 community development program to be used by the department for 31 the purposes of the program. 32 Sec. 7. WORKFORCE DEVELOPMENT FUND. There is appropriated 33 from the workforce development fund account created in section 34 15.342A to the workforce development fund created in section 35 -6- LSB 5089JB (2) 83 tw/tm 6/ 16

From moneys 7 appropriated or transferred to or receipts credited to the 8 workforce development fund created in section 15.343, up to 9 $400,000 for the fiscal year beginning July 1, 2010, and ending 10 June 30, 2011, are appropriated to the department of economic 11 development for the administration of workforce development 12 activities including salaries, support, maintenance, and 13 miscellaneous purposes, and for not more than the following 14 full-time equivalent positions: 15 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . FTEs 4.00 16 Sec. 9. JOB TRAINING FUND. Notwithstanding section 15.251, 17 all moneys in the job training fund on July 1, 2010, and any 18 moneys appropriated or credited to the fund during the fiscal 19 year beginning July 1, 2010, shall be transferred to the 20 workforce development fund established pursuant to section 21 15.343. 22 Sec. 10. IOWA STATE UNIVERSITY. 23 1. There is appropriated from the general fund of the state 24 to Iowa state university of science and technology for the 25 fiscal year beginning July 1, 2010, and ending June 30, 2011, 26 the following amount, or so much thereof as is necessary, to 27 be used for small business development centers, the science 28 and technology research park, and the institute for physical 29 research and technology, and for not more than the following 30 full-time equivalent positions: 31 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 2,575,983 32 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . FTEs 56.63 33 2. Of the moneys appropriated in subsection 1, Iowa state 34 university of science and technology shall allocate at least 35 -7- LSB 5089JB (2) 83 tw/tm 7/ 16

Iowa state university of science and technology may 2 allocate moneys appropriated in subsection 1 to the various 3 small business development centers in any manner necessary to 4 achieve the purposes of this subsection. 5 3. Iowa state university of science and technology shall do 6 all of the following: 7 a. Direct expenditures for research toward projects that 8 will provide economic stimulus for Iowa. 9 b. Provide emphasis to providing services to Iowa-based 10 companies. 11 4. It is the intent of the general assembly that the 12 industrial incentive program focus on Iowa industrial 13 sectors and seek contributions and in-kind donations from 14 businesses, industrial foundations, and trade associations, 15 and that moneys for the institute for physical research and 16 technology industrial incentive program shall be allocated 17 only for projects which are matched by private sector moneys 18 for directed contract research or for nondirected research. 19 The match required of small businesses as defined in section 20 15.102, subsection 6, for directed contract research or for 21 nondirected research shall be $1 for each $3 of state funds. 22 The match required for other businesses for directed contract 23 research or for nondirected research shall be $1 for each $1 of 24 state funds. The match required of industrial foundations or 25 trade associations shall be $1 for each $1 of state funds. 26 Iowa state university of science and technology shall 27 report annually to the joint appropriations subcommittee on 28 economic development and the legislative services agency the 29 total amount of private contributions, the proportion of 30 contributions from small businesses and other businesses, and 31 the proportion for directed contract research and nondirected 32 research of benefit to Iowa businesses and industrial sectors. 33 5. Notwithstanding section 8.33, moneys appropriated in 34 this section that remain unencumbered or unobligated at the 35 -8- LSB 5089JB (2) 83 tw/tm 8/ 16

UNIVERSITY OF NORTHERN IOWA. 27 1. There is appropriated from the general fund of the 28 state to the university of northern Iowa for the fiscal year 29 beginning July 1, 2010, and ending June 30, 2011, the following 30 amount, or so much thereof as is necessary, to be used for the 31 metal casting institute, the MyEntreNet internet application, 32 and the institute of decision making, including salaries, 33 support, maintenance, miscellaneous purposes, and for not more 34 than the following full-time equivalent positions: 35 -9- LSB 5089JB (2) 83 tw/tm 9/ 16

Notwithstanding section 8.33, moneys appropriated in 13 this section that remain unencumbered or unobligated at the 14 close of the fiscal year shall not revert but shall remain 15 available for expenditure for the purposes designated until the 16 close of the succeeding fiscal year. 17 Sec. 13. BOARD OF REGENTS REPORT. The state board of 18 regents shall submit a report on the progress of regents 19 institutions in meeting the strategic plan for technology 20 transfer and economic development to the secretary of the 21 senate, the chief clerk of the house of representatives, and 22 the legislative services agency by January 15, 2011. 23 Sec. 14. DEPARTMENT OF WORKFORCE DEVELOPMENT. There 24 is appropriated from the general fund of the state to the 25 department of workforce development for the fiscal year 26 beginning July 1, 2010, and ending June 30, 2011, the following 27 amounts, or so much thereof as is necessary, for the purposes 28 designated: 29 1. FTEs 30.00 10 The division of workers’ compensation shall charge a $100 11 filing fee for workers’ compensation cases. The filing fee 12 shall be paid by the petitioner of a claim. However, the fee 13 can be taxed as a cost and paid by the losing party, except 14 in cases where it would impose an undue hardship or be unjust 15 under the circumstances. The moneys generated by the filing 16 fee allowed under this subsection are appropriated to the 17 department of workforce development to be used for purposes of 18 administering the division of workers’ compensation. 19 3. WORKFORCE DEVELOPMENT OPERATIONS 20 For the operation of field offices, the workforce 21 development board, and new Iowans centers, and for not more 22 than the following full-time equivalent positions: 23 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 11,343,047 24 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . FTEs 88.28 25 Of the moneys appropriated in this subsection, the 26 department shall allocate $11,110,137 for the operation of 27 field offices. The department shall not reduce the number of 28 field offices below the number of field offices being operated 29 as of January 1, 2009. 30 The department of workforce development shall make every 31 effort to maintain new Iowans centers that offer one-stop 32 services to deal with the multiple issues related to 33 immigration and employment. The centers shall be designed to 34 support workers, businesses, and communities with information, 35 -11- LSB 5089JB (2) 83 tw/tm 11/ 16
S.F. _____ H.F. _____ referrals, job placement assistance, translation, language 1 training, and resettlement, as well as technical and legal 2 assistance on such issues as forms and documentation. Through 3 the coordination of local, state, and federal service 4 providers, and through the development of partnerships with 5 public, private, and nonprofit entities with established 6 records of international service, these centers shall seek to 7 provide a seamless service delivery system for new Iowans. 8 4. OFFENDER REENTRY PROGRAM 9 For the development and administration of an offender 10 reentry program to provide offenders with employment skills, 11 and for not more than the following full-time equivalent 12 positions: 13 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 322,261 14 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . Notwithstanding section 8.33, moneys appropriated 24 in subsections 1 through 4 of this section that remain 25 unencumbered or unobligated at the close of the fiscal year 26 shall not revert but shall remain available for expenditure 27 for the purposes designated until the close of the succeeding 28 fiscal year. 29 Sec. 15. ACCOUNTABILITY —— AUDIT. The auditor of state 30 shall annually conduct an audit of the department of workforce 31 development and shall report the findings of such annual 32 audit, including the accountability of programs of the 33 department, to the chairpersons and ranking members of the 34 joint appropriations subcommittee on economic development. IOWA FINANCE AUTHORITY AUDIT. The auditor of state 20 is requested to review the audit of the Iowa finance authority 21 performed by the auditor hired by the authority. 22 Sec. 22. UNEMPLOYMENT COMPENSATION PROGRAM. Notwithstanding 23 section 96.9, subsection 4, paragraph “a”, moneys credited to 24 the state by the secretary of the treasury of the United 25 States pursuant to section 903 of the Social Security 26 Act are appropriated to the department of workforce 27 development and shall be used by the department for the 28 administration of the unemployment compensation program only. 29 This appropriation shall not apply to any fiscal year 30 beginning after December 31, 2009. 31 Sec. 23. 2009 Iowa Acts, chapter 176, section 3, subsection 32 5, is amended to read as follows: 33 5. S.F. _____ H.F. _____ challenge grants for historic building preservation: 1 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 184,195 2 Notwithstanding section 8.33, moneys appropriated in this 3 subsection that remain unencumbered or unobligated at the close 4 of the fiscal year shall not revert but shall remain available 5 for expenditure for the purposes designated until the close of 6 the succeeding fiscal year. 7 Sec. 24. EFFECTIVE UPON ENACTMENT. The section of this Act 8 amending 2009 Iowa Acts, chapter 176, being deemed of immediate 9 importance, takes effect upon enactment. 10 EXPLANATION 11 This bill makes appropriations and transfers from the 12 general fund of the state and other funds to the department 13 of cultural affairs, the department of economic development, 14 the university of Iowa, the university of northern Iowa, Iowa 15 state university, the department of workforce development, and 16 the public employment relations board for the 2010-2011 fiscal 17 year. 18 The bill provides that the goals for the department of 19 economic development shall be to expand and stimulate the 20 state economy, increase the wealth of Iowans, and increase the 21 population of the state. 22 The bill transfers moneys collected by the division of 23 insurance in excess of the anticipated gross revenues to the 24 department of economic development for purposes of insurance 25 economic development and international insurance economic 26 development. 27 The bill appropriates moneys from the Iowa community 28 development loan fund to the department of economic development 29 for purposes of the community development program. 30 The bill appropriates moneys from the workforce development 31 fund account to the workforce development fund. 32 The bill provides that moneys appropriated or transferred 33 to or receipts credited to the workforce development fund are 34 appropriated to the department of economic development for 35 -15- LSB 5089JB (2) 83 tw/tm 15/ 16
S.F. _____ H.F. _____ administration of workforce development activities. 1 The bill provides that all moneys in the job training fund on 2 July 1, 2010, and any moneys appropriated or credited to the 3 fund during the fiscal year beginning July 1, 2010, shall be 4 transferred to the workforce development fund. 5 The bill requires the state board of regents to submit a 6 report on the progress of regents institutions in meeting 7 the strategic plan for technology transfer and economic 8 development. 9 The bill requires the auditor of state to conduct an audit of 10 the department of workforce development. 11 The bill appropriates moneys from the special employment 12 security contingency fund to the department of workforce 13 development for the division of workers’ compensation and for 14 the operation of field offices. 15 The bill appropriates interest earned on the unemployment 16 compensation reserve fund to the department of workforce 17 development for the operation of field offices. 18 The bill appropriates moneys to the department of workforce 19 development for an employee misclassification program. 20 The bill requests the auditor of state to review the audit 21 of the Iowa finance authority performed by the auditor hired 22 by the authority. 23 The bill appropriates moneys from moneys credited to 24 the state by the secretary of the treasury of the United 25 States pursuant to the Social Security Act to the department 26 of workforce development for the administration of the 27 unemployment compensation program only. 28 The bill provides for the filing of surety bonds or qualified 29 statements by out-of-state contractors with the division of 30 labor services. 31 The bill amends 2009 Iowa Acts, chapter 176, to provide for 32 the nonrevision of moneys appropriated for purposes of matching 33 funds for main street challenge grants.
