Section
135.105A,
subsection
5,
Code
Supplement

2009,
is
amended
to
read
as
follows:

5.
The
department
shall
adopt
rules
regarding
minimum
3
requirements
for
lead
inspector,
lead
abater,
and
lead-safe
4
renovator
training
programs,
certification,
work
practice
5
standards,
and
suspension
and
revocation
requirements,
and
6
shall
implement
the
training
and
certification
programs.
The
7
department
shall
seek
federal
funding
and
shall
establish
fees
8
in
amounts
sufficient
to
defray
the
cost
of
the
programs.
9
The
fees
shall
be
used
for
any
of
the
department’s
duties
10
under
this
division,
including
but
not
limited
to
the
costs
11
of
full-time
equivalent
positions
for
program
services
and
12
investigations.
Any
such
positions
are
in
addition
to
other
13
positions
authorized
for
the
department.
Fees
received
shall
14
be
considered
repayment
receipts
as
defined
in
section
8.2
,
and
15
notwithstanding
section
8.33,
any
amounts
of
such
fees
that
16
remain
unencumbered
or
unobligated
at
the
close
of
the
fiscal
17
year
shall
not
revert
to
any
fund
but
shall
remain
available
18
for
expenditure
for
the
purposes
designated
until
the
close
of
19
the
succeeding
fiscal
year
.

Sec.
2.
EFFECTIVE
UPON
ENACTMENT
AND
APPLICABILITY.
This
21
Act,
being
deemed
of
immediate
importance,
takes
effect
upon
22
enactment
and
applies
to
any
fees
collected
pursuant
to
section
23
135.105A
during
or
after
the
fiscal
year
beginning
July
1,
24
2009.

EXPLANATION
26
This
bill
authorizes
the
continuing
expenditure
of
repayment
27
receipts
for
lead
training
and
certification
collected
by
the
28
department
of
public
health
under
Code
section
135.105A
and
29
remaining
unexpended
or
unobligated
at
the
close
of
a
fiscal
30
year.
The
authorization
extends
to
the
subsequent
fiscal
year.
31
The
bill
also
requires
the
fees
collected
to
be
used
for
any
32
of
the
department’s
duties
under
division
VIII
of
the
division
33
of
Code
chapter
135,
pertaining
to
the
lead
abatement
program,

including
but
not
limited
to
the
costs
of
full-time
equivalent
