H.F. 2309 Section 1. NEW SECTION . 7G.1 National animal identification 1 system —— restrictions on implementation by state entities. 2 Unless expressly required by statute, an authority, board, 3 commission, council, department, or independent agency as 4 provided in chapter 7E, including any of its subunits or 5 offices, shall not use state moneys or direct state personnel 6 to implement the national animal identification system as may 7 be authorized by the animal and plant health inspection service 8 of the United States department of agriculture pursuant to 7 9 U.S.C. § 8301 et seq. 10 EXPLANATION 11 This bill provides that absent a statute expressly requiring 12 otherwise, a state agency is prohibited from using moneys or 13 directing state personnel from implementing the national animal 14 identification system (NAIS). The NAIS is administered by 15 the United States department of agriculture and when fully 16 operational is to provide for the registration of premises 17 where agricultural animals are kept, identify individual 18 agricultural animals and groups, and trace the movement of 19 agricultural animals. 20 -1- LSB 5804YH (3) 83 da/sc 1/ 1
