H.F. 2130 Section 1. Section 600A.8, Code Supplement 2009, is amended 1 by adding the following new subsection: 2 NEW SUBSECTION . 11. For a period of at least three years, 3 a noncustodial parent does either of the following and the 4 noncustodial parent has been previously cited for contempt 5 pursuant to section 598.23 or 598.23A: 6 a. Fails to make payments or provide medical support 7 pursuant to an order or decree for support entered pursuant 8 to chapter 598 or chapter 234, 252A, 252C, 252F, 600B, or any 9 other support chapter, or a comparable chapter of a foreign 10 jurisdiction. 11 b. Does not comply with a custody order or decree. 12 EXPLANATION 13 This bill provides that grounds for termination of parental 14 rights includes that for a period of at least three years, 15 a noncustodial parent against whom an order or decree for 16 support has been entered, fails to make payments or provide 17 medical support pursuant to that order or decree, or that the 18 noncustodial parent does not comply with a custody order or 19 decree, and the noncustodial parent has been previously cited 20 for contempt for noncompliance. 21 -1- LSB 5963HH (2) 83 pf/nh 1/ 1
