amended
to
read
as

(1)
For
a
person
subject
to
a
record
check,
in
addition
to
4
any
other
record
check
conducted
pursuant
to
this
subsection,
5
the
person’s
fingerprints
shall
be
provided
to
the
department
6
of
public
safety
for
submission
through
the
state
criminal
7
history
repository
to
the
United
States
department
of
justice,
8
federal
bureau
of
investigation
for
a
national
criminal
history
9
check.
The
department
may
adopt
rules
specifying
criteria
in
10
the
public
interest
for
requiring
the
national
criminal
history
11
check
shall
of
a
person
to
be
repeated
every
four
years
.

EXPLANATION
13
This
bill
relates
to
the
requirements
for
national
criminal
14
history
record
checks
for
certain
child
care
providers.
15
Under
current
law
in
Code
section
237A.5,
relating
to
child
16
care
personnel,
a
national
criminal
record
check
is
required
17
for
persons
being
considered
for
child
care
licensure
or
18
registration,
for
employment
in
child
care,
for
receiving
19
public
funding
for
providing
child
care,
or
for
residing
in
20
a
child
care
facility
or
child
care
home
receiving
public
21
funding.
For
the
period
beginning
on
and
after
January
1,
22
2010,
through
June
30,
2013,
the
national
criminal
record
check
23
requirement
only
applies
to
licensed
child
care
centers
and
to
24
child
development
home
providers
who
voluntarily
license.
25
The
bill
replaces
a
requirement
for
repeating
the
26
national
criminal
check
requirement
every
four
years
with
an
27
authorization
for
the
department
of
human
services
to
adopt
28
rules
specifying
criteria
in
the
public
interest
for
requiring
29
the
national
check
of
a
person
to
be
repeated.
