1.
COLLECTIVE
BARGAINING
AGREEMENT
——
RENEGOTIATION

COMPENSATION
TERMS.

1.
The
general
assembly
finds
that
in
order
to
avoid
3
layoffs,
reductions
in
salary
costs
must
be
achieved.
As
a
4
result,
the
governor,
the
state
court
administrator,
and
the
5
state
board
of
regents
shall
renegotiate
with
state
labor
6
unions
the
collective
bargaining
agreements
effective
during
7
the
fiscal
year
beginning
July
1,
2010,
and
ending
June
30,
8
2011.

2.
The
governor,
the
state
court
administrator,
and
the
10
state
board
of
regents
shall
apply
all
of
the
following
terms
11
in
the
renegotiated
collective
bargaining
agreements
effective
12
during
the
fiscal
year
beginning
July
1,
2010,
and
ending
June
13
30,
2011:
14
a.
A
cost
of
living
increase
shall
not
be
granted.
The
pay
15
plans
as
they
exist
for
the
fiscal
year
ending
June
30,
2010,
16
shall
be
the
pay
plans
used
for
the
fiscal
year
ending
June
30,
17
2011.
18
b.
A
five
percent
salary
decrease
shall
be
implemented.
The
19
salary
decrease
shall
be
calculated
using
the
pay
plans
as
they
20
exist
for
the
fiscal
year
ending
June
30,
2010.

c.
Employees
shall
not
receive
a
step
increase
or
the
22
equivalent
of
a
step
increase.

3.
For
the
fiscal
year
beginning
July
1,
2010,
and
ending
24
June
30,
2011,
the
provisions
of
subsection
2
shall
apply
to
25
all
pay
plans
provided
for
in
section
8A.413,
subsection
3,
26
and
shall
apply
to
all
employees
not
covered
by
a
collective
27
bargaining
agreement.

4.
For
the
fiscal
year
beginning
July
1,
2010,
and
ending
29
June
30,
2011,
the
provisions
of
subsection
2
shall
apply
30
to
all
state
board
of
regents
employees
not
covered
by
a
31
collective
bargaining
agreement.

5.
For
the
fiscal
year
beginning
July
1,
2010,
and
ending
33
June
30,
2011,
the
provisions
of
subsection
2
shall
apply
to
34
all
legislative
and
judicial
branch
employees
not
covered
by
a

collective
bargaining

Any
moneys
appropriated
from
the
general
fund
of
the
2
state
to
a
department,
commission,
board,
agency,
the
state

board
of
regents,
the
judicial
branch,
or
the
legislative
4
branch
for
purposes
of
salaries
that
are
not
expended
as
a
5
result
of
the
provisions
of
subsection
2
shall
remain
in
the
6
general
fund
and
shall
not
be
expended
for
any
other
purpose.

Sec.
2.
EFFECTIVE
UPON
ENACTMENT.
This
Act,
being
deemed
of
8
immediate
importance,
takes
effect
upon
enactment.

EXPLANATION
10
This
bill
relates
to
salary
terms
for
state
employees.
11
The
bill
requires
the
governor,
the
state
court
12
administrator,
and
the
state
board
of
regents
to
renegotiate
13
with
state
labor
unions
the
collective
bargaining
agreements
14
effective
during
the
fiscal
year
beginning
July
1,
2010,
and
15
ending
June
30,
2011.
The
bill
requires
the
renegotiated
16
contracts
to
prohibit
a
cost
of
living
increase,
to
require
a
5
17
percent
salary
decrease,
and
to
prohibit
a
step
increase
or
the
18
equivalent
of
a
step
increase.
19
The
bill
provides
that
the
renegotiated
terms
shall
apply
20
to
all
employees
of
the
executive,
legislative,
and
judicial
21
branches.
22
The
bill
provides
that
moneys
appropriated
from
the
state
23
general
fund
that
are
not
expended
as
a
result
of
the
mandated
24
compensation
terms
shall
remain
in
the
general
fund
and
shall
25
not
be
expended
for
any
other
purpose.
26
The
bill
takes
effect
upon
enactment.
