amended
to
read

follows:

Coverage
for
immunizations
——
mercury
.

1.
Third-party
payment
provider
contracts
or
policies
4
delivered,
issued
for
delivery,
continued,
or
renewed
in
this
5
state
on
or
after
January
1,
2006,
that
provide
reimbursement
6
for
immunizations
shall
provide
reimbursement
for
immunizations
7
containing
no
more
than
trace
amounts
of
mercury
at
the
8
acquisition
cost
rate
for
immunizations
containing
no
more
than
9
trace
amounts
of
mercury.
For
the
purposes
of
this
section,
10
“trace
amounts”
means
trace
amounts
as
defined
by
the
United
11
States
food
and
drug
administration.

Third-party
payment
provider
contracts
or
policies

delivered,
issued
for
delivery,
continued,
or
renewed
in
this
14
state
on
or
after
July
1,
2010,
that
provide
reimbursement
for
15
immunizations
shall
provide
reimbursement
for
immunizations
for
16
influenza
that
are
administered
at
any
location
so
long
as
the
17
immunization
is
administered
by
a
health
care
provider
who
is
18
licensed
to
administer
immunizations
for
influenza.

the
purposes
of
this
section,
“third-party
20
payment
provider
contracts
or
policies”
includes:
21
a.
Individual
or
group
accident
and
sickness
insurance
22
providing
coverage
on
an
expense-incurred
basis.

b.
An
individual
or
group
hospital
or
medical
service
24
contract
issued
pursuant
to
chapter
509,
514,
or
514A.
25
c.
An
individual
or
group
health
maintenance
organization
26
contract
regulated
under
chapter
514B.
27
d.
An
organized
delivery
system
licensed
by
the
director
of
28
public
health.

EXPLANATION
30
This
bill
provides
that
third-party
payment
provider
31
contracts
or
policies
that
provide
reimbursement
for
32
immunizations,
must
provide
reimbursement
for
immunizations
for
33
influenza
that
are
administered
at
any
location
by
a
health
34
care
provider
who
is
licensed
to
administer
such
immunizations.
