  1  1    Section 1.  Section 257.31, subsection 5, paragraph j, Code
  1  2 2007, is amended to read as follows:
  1  3    j.  Unusual need to continue providing a program or other
  1  4 special assistance to non=English speaking pupils after the
  1  5 expiration of the four=year five=year period specified in
  1  6 section 280.4.
  1  7    Sec. 2.  Section 280.4, subsection 3, Code 2007, is amended
  1  8 to read as follows:
  1  9    3.  In order to provide funds for the excess costs of
  1 10 instruction of limited English proficient students above the
  1 11 costs of instruction of pupils in a regular curriculum,
  1 12 students identified as limited English proficient shall be
  1 13 assigned an additional weighting of twenty=two hundredths, and
  1 14 that weighting shall be included in the weighted enrollment of
  1 15 the school district of residence for a period not exceeding
  1 16 four five years.  However, the school budget review committee
  1 17 may grant supplemental aid or modified allowable growth to a
  1 18 school district to continue funding a program for students
  1 19 after the expiration of the four=year five-year period.
  1 20    Sec. 3.  EFFECTIVE AND APPLICABILITY DATES.  This Act,
  1 21 being deemed of immediate importance, takes effect upon
  1 22 enactment and is applicable for the school budget year
  1 23 beginning July 1, 2007, and succeeding budget years.
  1 24                            EXPLANATION
  1 25    This bill provides an extension of the period of time for
  1 26 which a school district may receive supplementary weighting
  1 27 for limited English proficient students from the current
  1 28 period of four years to five years.  The bill makes a
  1 29 corresponding change to a provision that the school budget
  1 30 review committee may grant supplemental aid or modified
  1 31 allowable growth to a district after expiration of the
  1 32 supplemental weighting time frame.
  1 33    The bill takes effect upon enactment and is applicable for
  1 34 the school budget year beginning July 1, 2007, and succeeding
  1 35 budget years.
