  1 An Act making appropriations to the department of education and
  2    the state board of regents to reimburse community colleges and
  3    institutions of higher education governed by the board for the
  4    costs of providing certain education=related services.

  1  1    Section 1.  DEPARTMENT OF EDUCATION == EDUCATIONAL SERVICES
  1  2 CLAIMS.  There is appropriated from the general fund of the
  1  3 state to the department of education for the fiscal year
  1  4 beginning July 1, 2007, and ending June 30, 2008, the
  1  5 following amount, or so much thereof as is necessary, to be
  1  6 used for the purposes designated:
  1  7    To reimburse community colleges for the costs of providing
  1  8 education=related services to hearing=impaired students and
  1  9 students with disabilities:
  1 10 .................................................. $    750,000
  1 11    By September 1, 2007, each community college shall submit
  1 12 all claims and supporting documentation for the costs for
  1 13 providing education=related services to hearing=impaired
  1 14 students and students with disabilities during the previous
  1 15 fiscal year to the department, which shall reimburse the
  1 16 community colleges for established claims by October 15, 2007.
  1 17 If funds appropriated under this section are insufficient to
  1 18 pay claims in full, the department of education shall prorate
  1 19 payments to community colleges in the proportion that each
  1 20 community college's claim is to the total amount claimed by
  1 21 all community colleges submitting claims.
  1 22    Sec. 2.  STATE BOARD OF REGENTS == EDUCATIONAL SERVICES
  1 23 CLAIMS.  There is appropriated from the general fund of the
  1 24 state to the state board of regents for the fiscal year
  1 25 beginning July 1, 2007, and ending June 30, 2008, the
  1 26 following amount, or so much thereof as is necessary, to be
  1 27 used for the purposes designated:
  1 28    To reimburse institutions of higher education governed by
  1 29 the board for the costs of providing education=related
  1 30 services to hearing=impaired students and students with
  1 31 disabilities:
  1 32 .................................................. $    750,000
  1 33    By September 1, 2007, each institution of higher education
  1 34 governed by the board shall submit all claims and supporting
  1 35 documentation for the costs for providing education=related
  2  1 services to hearing=impaired students and students with
  2  2 disabilities during the previous fiscal year to the board,
  2  3 which shall reimburse the institutions for established claims
  2  4 by October 15, 2007.  If funds appropriated under this section
  2  5 are insufficient to pay claims in full, the board shall
  2  6 prorate payments to the institutions in the proportion that
  2  7 each institution's claim is to the total amount claimed by all
  2  8 institutions submitting claims.
  2  9                           EXPLANATION
  2 10    This bill appropriates $750,000 each to the department of
  2 11 education and to the state board of regents to pay claims
  2 12 submitted by the community colleges and the state universities
  2 13 for the costs of providing education=related services to
  2 14 hearing=impaired students and students with disabilities.  The
  2 15 community colleges must submit their claims and supporting
  2 16 documentation to the department, and the universities their
  2 17 claims and supporting documentation to the board, by September
  2 18 1, 2007.  The department and the board must pay established
  2 19 claims by October 15, 2007.
  2 20    If the funds appropriated are insufficient to pay claims in
  2 21 full, both the department and the board are directed to
  2 22 prorate payments to the community colleges and universities in
  2 23 the proportion that each community college's or university's
  2 24 claim is to the total amount claimed by all community colleges
  2 25 or all universities submitting claims.
