  1  1    Section 1.  Section 135.26, Code Supplement 2005, is
  1  2 amended to read as follows:
  1  3    135.26  AUTOMATED EXTERNAL DEFIBRILLATOR GRANT PROGRAM.
  1  4    The department shall establish and implement an automated
  1  5 external defibrillator grant program which provides matching
  1  6 funds to local boards of health, community organizations, or
  1  7 cities for the program after standards and requirements for
  1  8 the utilization of automated external defibrillator equipment,
  1  9 and training on the use of such equipment, are developed at
  1 10 the local level. involving the distribution of both basic=
  1 11 level and advanced=level external defibrillator equipment, as
  1 12 follows:
  1 13    1.  For basic=level automated external defibrillator
  1 14 equipment, for use primarily by emergency medical care
  1 15 providers other than those referred to in subsection 2 and the
  1 16 general public, the grant program shall provide matching funds
  1 17 to local boards of health, community organizations, or cities
  1 18 after standards and requirements for the utilization of basic=
  1 19 level automated external defibrillator equipment, and training
  1 20 on the use of such equipment, are developed at the local
  1 21 level.  The objective of the program shall be to enhance the
  1 22 emergency response system in rural areas of the state where
  1 23 access to health care providers is often limited by providing
  1 24 increased access to basic=level automated external
  1 25 defibrillator equipment by rural emergency and community
  1 26 personnel.  A local board of health, community organization,
  1 27 or city may submit an application to the department for
  1 28 review.  The department shall establish criteria for the
  1 29 review and approval of grant applications by rule, and may
  1 30 accept gifts, grants, bequests, and other private
  1 31 contributions, as well as state or federal funds, for purposes
  1 32 of the program.  The amount of a grant shall not exceed fifty
  1 33 percent of the cost of the basic=level automated external
  1 34 defibrillator equipment to be distributed to the applicant and
  1 35 the training program to be administered by the applicant at
  2  1 the local level.  Each application shall include information
  2  2 demonstrating that the applicant will provide matching funds
  2  3 of fifty percent of the cost of the program.  Grant recipients
  2  4 shall submit an annual report to the department indicating
  2  5 automated external defibrillator equipment usage levels,
  2  6 patient outcomes, and number of individuals trained.
  2  7    2.  For advanced=level external defibrillator equipment,
  2  8 for use primarily by emergency medical care providers trained
  2  9 at the EMT=paramedic or higher certification level, as
  2 10 referred to in section 147A.1, subsection 4, the grant program
  2 11 shall provide matching funds to municipal fire departments and
  2 12 ambulance, rescue, or first response services after standards
  2 13 and requirements for the utilization of advanced=level
  2 14 external defibrillator equipment, and training on the use of
  2 15 such equipment, are developed at the local level.  The
  2 16 objective of the program shall be to enhance the availability
  2 17 of advanced=level external defibrillators for use in advanced
  2 18 life support applications by trained EMT=paramedics.  A
  2 19 municipal fire department or ambulance, rescue, or first
  2 20 response service may submit an application to the department
  2 21 for review.  The department shall establish criteria for the
  2 22 review and approval of grant applications by rule, and may
  2 23 accept gifts, grants, bequests, and other private
  2 24 contributions, as well as state or federal funds, for purposes
  2 25 of the program.  In determining approval criteria, the
  2 26 department shall award a preference for applicants
  2 27 demonstrating the possession of comparatively outdated
  2 28 equipment and limited financial resources.  The amount of a
  2 29 grant shall not exceed seventy=five percent of the cost of the
  2 30 advanced=level external defibrillator equipment to be
  2 31 distributed to the applicant and the training program to be
  2 32 administered by the applicant at the local level.  Each
  2 33 application shall include information demonstrating that the
  2 34 applicant will provide matching funds of twenty=five percent
  2 35 of the cost of the program.  Grant recipients shall submit an
  3  1 annual report to the department indicating external
  3  2 defibrillator equipment usage levels, patient outcomes, and
  3  3 number of individuals trained.
  3  4    Sec. 2.  EXTERNAL DEFIBRILLATOR GRANT PROGRAM ==
  3  5 APPROPRIATIONS.  There is appropriated from the healthy Iowans
  3  6 tobacco trust created in section 12.65 to the Iowa department
  3  7 of public health for the fiscal year beginning July 1, 2006,
  3  8 and ending June 30, 2007, the following amounts, or so much
  3  9 thereof as is necessary, to be used for the purposes
  3 10 designated:
  3 11    1.  For the external defibrillator grant program
  3 12 established pursuant to section 135.26, subsection 1, for
  3 13 administering grants for basic=level automated external
  3 14 defibrillator equipment:
  3 15 .................................................. $    250,000
  3 16    2.  For the external defibrillator grant program
  3 17 established pursuant to section 135.26, subsection 2, for
  3 18 administering grants for advanced=level external defibrillator
  3 19 equipment:
  3 20 .................................................. $    250,000
  3 21    Notwithstanding section 8.33, moneys appropriated in this
  3 22 section that remain unencumbered or unobligated at the close
  3 23 of the fiscal year shall not revert but shall remain available
  3 24 for expenditure for the purposes designated until the close of
  3 25 the succeeding fiscal year.
  3 26                           EXPLANATION
  3 27    This bill modifies the existing automated external
  3 28 defibrillator grant program established in Code section 135.26
  3 29 to provide for a two=tiered external defibrillator grant
  3 30 program.
  3 31    In addition to the existing program, the bill adds a second
  3 32 grant program for advanced=level external defibrillator
  3 33 equipment intended for use by emergency medical care providers
  3 34 trained at the EMT=paramedic or higher certification level, as
  3 35 defined in Code section 147A.1, subsection 4.  The bill
  4  1 provides that the new grant program shall provide matching
  4  2 funds to municipal fire departments and ambulance, rescue, or
  4  3 first response services after standards and requirements for
  4  4 the utilization of advanced=level external defibrillator
  4  5 equipment, and training on the use of such equipment, are
  4  6 developed.  The bill states that the objective of the program
  4  7 is to enhance the availability of advanced=level external
  4  8 defibrillators for use in advanced life support applications
  4  9 by trained EMT=paramedics.
  4 10    The bill provides that a municipal fire department, or
  4 11 ambulance, rescue, or first response service, may submit an
  4 12 application to the department for review.  The department
  4 13 shall establish criteria for the review and approval of grant
  4 14 applications by rule, and may accept gifts, grants, bequests,
  4 15 and other private contributions, as well as state or federal
  4 16 funds, for purposes of the program.  In determining approval
  4 17 criteria, the bill provides that the department shall award a
  4 18 preference for applicants demonstrating the possession of
  4 19 comparatively outdated equipment and limited financial
  4 20 resources.  The bill provides that a grant shall be awarded on
  4 21 a 75 percent grant, 25 percent local match, basis with regard
  4 22 to the cost of the equipment and the training program to be
  4 23 administered by the applicant.  Additionally, as with the
  4 24 current program, grant recipients shall submit an annual
  4 25 report to the department indicating external defibrillator
  4 26 equipment usage levels, patient outcomes, and number of
  4 27 individuals trained.
  4 28    With the addition of the advanced=level grant program, the
  4 29 bill modifies provisions of the existing program to clarify
  4 30 that it relates to basic=level automated equipment.
  4 31    The bill makes an appropriation from the healthy Iowans
  4 32 tobacco trust created in Code section 12.65 to the Iowa
  4 33 department of public health for the 2006=2007 fiscal year of a
  4 34 total of $500,000.  The bill allocates $250,000 of the
  4 35 appropriation to each of the two external defibrillator grant
  5  1 programs.
