                                      A BILL FOR

  1 An Act relating to gambling on excursion boats and at racetracks,
  2    by eliminating the ongoing reauthorization requirement of a
  3    referendum permitting gambling games and the cruise
  4    requirement for excursion gambling boats.

  1  1    Section 1.  Section 99F.4, subsection 17, Code 2003, is
  1  2 amended to read as follows:
  1  3    17.  To define the excursion season and the duration of an
  1  4 excursion.  While an excursion gambling boat is docked,
  1  5 passengers may embark or disembark at any time during its
  1  6 business hours.  The commission shall not have the authority
  1  7 to require that an excursion gambling boat leave the dock and
  1  8 cruise in order to operate gambling games on the boat.
  1  9    Sec. 2.  Section 99F.7, subsection 10, paragraph d, Code
  1 10 2003, is amended by striking the paragraph.
  1 11                           EXPLANATION
  1 12    This bill amends Code section 99F.4, relating to the powers
  1 13 of the racing and gaming commission, to eliminate the
  1 14 authority of the racing and gaming commission to provide for
  1 15 the duration of an excursion on an excursion gambling boat.
  1 16 In addition, the bill provides that the commission shall not
  1 17 have the authority to require that an excursion gambling boat
  1 18 cruise in order to operate gambling games.
  1 19    The bill eliminates the requirement that the proposition to
  1 20 operate gambling games on an excursion boat or racetrack must
  1 21 be resubmitted to the county electorate for a vote every eight
  1 22 years beginning in 2002 once that county has authorized the
  1 23 operation of the gambling games by vote.  The requirement that
  1 24 the county vote on the initial determination of whether to
  1 25 authorize gambling games in the county is not amended by this
  1 26 bill.
