NEW SECTION. 306.8B INTERSTATE BRIDGES == 1 2 TRANSFER PROHIBITED. 1 3 Notwithstanding section 306.8 or 306.8A, an agreement for 1 4 transfer of jurisdiction of a primary road to a city may not 1 5 include any portion of a road that is a bridge directly 1 6 connecting Iowa to an adjoining state. 1 7 Sec. 2. PRIOR AGREEMENTS. Notwithstanding section 306.8B, 1 8 as enacted in this Act, a city that has assumed jurisdiction 1 9 and control of a bridge described in that section pursuant to 1 10 an agreement under 2003 Iowa Acts, chapter 144, may elect to 1 11 continue that agreement. If the city does not elect to 1 12 continue the agreement, the city shall return to the treasurer 1 13 of state for reimbursement to the primary road fund any moneys 1 14 apportioned and paid to the city for the fiscal year beginning 1 15 July 1, 2003, for maintenance of the bridge, as determined by 1 16 the state department of transportation. 1 17 Sec. 3. EFFECTIVE AND APPLICABILITY DATES. This Act, 1 18 being deemed of immediate importance, takes effect upon 1 19 enactment and applies retroactively to July 1, 2003, for 1 20 agreements entered into on or after that date. 1 21 EXPLANATION 1 22 This bill provides that an agreement to transfer 1 23 jurisdiction of a primary road to a city may not include 1 24 transfer of jurisdiction of a bridge that provides a direct 1 25 connection between Iowa and an adjoining state. The bill 1 26 applies retroactively to July 1, 2003, and therefore applies 1 27 to agreements identified in the transfer of jurisdiction 1 28 report referred to in Code section 306.8A. A city that has 1 29 assumed jurisdiction of an interstate bridge that is part of a 1 30 road identified in that report pursuant to an agreement 1 31 effective July 1, 2003, may elect to continue the agreement, 1 32 or the city may cancel the agreement and reimburse the primary 1 33 road fund for any moneys received in the 2003 fiscal year for 1 34 maintenance of the bridge. 1 35 LSB 5201SS 80 2 1 dea/pj/5
