1 An Act relating to the use of sick leave by certain members of
2 the Iowa department of public safety peace officers'
3 retirement, accident, and disability system who are
4 temporarily incapacitated for duty.
5 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 1 Section 1. Section 97A.6, subsection 5, paragraph b, Code
1 2 2003, is amended to read as follows:
1 3 b. Should a member in service become incapacitated for
1 4 duty as a natural and proximate result of an injury, disease,
1 5 or exposure incurred or aggravated while in the actual
1 6 performance of duty at some definite time or place, the member
1 7 shall, upon being found to be temporarily incapacitated
1 8 following an examination by the board of trustees, be entitled
1 9 to receive the member's fixed pay and allowances, without
1 10 using the member's sick leave, until re=examined reexamined by
1 11 the board and found to be fully recovered or permanently
1 12 disabled. In addition, a member found to be temporarily
1 13 incapacitated under this paragraph shall be credited with any
1 14 sick leave used prior to the determination that the member was
1 15 temporarily incapacitated under this paragraph for the period
1 16 of time sick leave was used.
1 17 EXPLANATION
1 18 This bill provides that a member of the Iowa department of
1 19 public safety peace officers' retirement, accident, and
1 20 disability system (PORS) who is determined by the PORS board
1 21 to be temporarily incapacitated in the line of duty shall not
1 22 be required to use the member's sick leave during the period
1 23 of time the member is temporarily incapacitated.
