Section 692A.2A, subsection 4, Code 2003, is 1 2 amended by adding the following new paragraph: 1 3 NEW PARAGRAPH. aa. The person resides at a hospital as 1 4 defined in section 135B.1, a health care facility as defined 1 5 in section 135C.1, or the Iowa veterans home. 1 6 EXPLANATION 1 7 This bill relates to the residency requirements of a sex 1 8 offender. 1 9 The bill provides that a sex offender may reside within 1 10 2,000 feet of an elementary or secondary school, or day care 1 11 facility, if the person resides at a hospital as defined in 1 12 Code section 135B.1, a health care facility as defined in Code 1 13 section 135C.1, or the Iowa veterans home. 1 14 Current law provides that a sex offender may only reside 1 15 within 2,000 feet of an elementary or secondary school, or day 1 16 care facility, if the person is required to serve a sentence 1 17 at a jail or prison, or the person is subject to an order of 1 18 commitment under Code chapter 229A, or the person has 1 19 established a residence prior to July 1, 2002, or a school or 1 20 child care facility is newly located on or after July 1, 2002, 1 21 or the person is a minor or a ward under a guardianship. 1 22 LSB 2788YH 80 1 23 jm/cl/14 1 24 1 25 1 26 1 27 1 28 1 29 1 30 1 31 1 32 1 33 1 34 1 35
