  1 An Act modifying the requirements for cities and counties to
  2    enter into certain leases.
  3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

  1  1    Section 1.  Section 346.27, Code 2003, is amended by adding
  1  2 the following new subsection:
  1  3    NEW SUBSECTION.  26.  Any incorporating unit may enter into
  1  4 a lease with an authority that the authority and the
  1  5 incorporating unit determine is necessary and convenient to
  1  6 effectuate their purposes and the purposes of this section.
  1  7 The power to enter into leases under this section is in
  1  8 addition to other powers granted to cities and counties to
  1  9 enter into leases and the provisions of section 364.4,
  1 10 subsection 4, and section 331.301, subsection 10, are not
  1 11 applicable to leases entered into under this section.
  1 12                           EXPLANATION
  1 13    This bill provides that a city or county may enter into a
  1 14 lease with a joint city=county authority when the city or
  1 15 county and the authority determine that such a lease is
  1 16 necessary and convenient to effectuate their purposes and the
  1 17 purposes of Code section 346.27.
  1 18    The bill also provides that the power to enter into leases
  1 19 under this Code section is in addition to other powers granted
  1 20 to cities and counties to enter into leases and the provisions
  1 21 of Code section 364.4, subsection 4, and Code section 331.301,
  1 22 subsection 10, which require a city or county entering into a
  1 23 lease to follow the authorization procedure which requires an
  1 24 affirmative vote of 60 percent of the votes cast on the
  1 25 question, are not applicable and instead only a majority vote
  1 26 is required for authorization of leases entered into under
  1 27 this Code section.
