  2    making an appropriation, and providing an effective date.

  1  1    Section 1.  Section 256D.4, subsection 1, unnumbered
  1  2 paragraph 1, Code 2003, is amended to read as follows:
  1  3    For each fiscal year in the fiscal period beginning July 1,
  1  4 1999, and ending June 30, 2001, moneys Moneys appropriated
  1  5 pursuant to section 256D.5, subsections 1 or 2, shall be
  1  6 allocated to school districts in accordance with the following
  1  7 formula:
  1  8    Sec. 2.  Section 256D.4, subsection 2, Code 2003, is
  1  9 amended by striking the subsection.
  1 10    Sec. 3.  Section 256D.4, subsection 3, Code 2003, is
  1 11 amended to read as follows:
  1 12    3.  For each year in which an appropriation is made to the
  1 13 Iowa early intervention block grant program pursuant to
  1 14 section 256D.5, the department of education shall notify the
  1 15 department of revenue and finance of the amount of the
  1 16 allocation to be paid to each school district as provided in
  1 17 subsections subsection 1 and 2.  The allocation to each school
  1 18 district shall be made in one payment on or about October 15
  1 19 of the fiscal year for which the appropriation is made, taking
  1 20 into consideration the relative budget and cash position of
  1 21 the state resources.  Moneys received under this section shall
  1 22 not be commingled with state aid payments made under section
  1 23 257.16 to a school district and shall be accounted for by the
  1 24 local school district separately from state aid payments.
  1 25 Payments made to school districts under this section are
  1 26 miscellaneous income for purposes of chapter 257.  A school
  1 27 district shall maintain a separate listing within its budget
  1 28 for payments received and expenditures made pursuant to this
  1 29 section.  A school district shall certify to the department of
  1 30 education that moneys received under this section were used to
  1 31 supplement, not supplant, moneys otherwise received and used
  1 32 by the school district.
  1 33    Sec. 4.  Section 256D.5, Code 2003, is amended to read as
  1 34 follows:
  1 35    256D.5  APPROPRIATIONS.
  2  1    There is appropriated from the general fund of the state to
  2  2 the department of education, the following amounts, for the
  2  3 following fiscal years, for the Iowa early intervention block
  2  4 grant program:
  2  5    1.  For the fiscal year beginning July 1, 1999, and ending
  2  6 June 30, 2000, the sum of ten million dollars There is
  2  7 appropriated from the general fund of the state to the
  2  8 department of education, for each fiscal year of the fiscal
  2  9 period beginning July 1, 2001, and ending June 30, 2003, the
  2 10 sum of thirty million dollars for the Iowa early intervention
  2 11 block grant program.
  2 12    2.  For the fiscal year beginning July 1, 2000, and ending
  2 13 June 30, 2001, the sum of twenty million dollars There is
  2 14 appropriated from the general fund of the state to the
  2 15 department of education for each fiscal year of the fiscal
  2 16 period beginning July 1, 2003, and ending June 30, 2005, the
  2 17 sum of thirty million dollars for the school improvement
  2 18 technology block grant program.
  2 19    3.  For each fiscal year of the fiscal period beginning
  2 20 July 1, 2001, and ending June 30, 2003, the sum of thirty
  2 21 million dollars.
  2 22    Sec. 5.  NEW SECTION.  256D.6  DISTRIBUTION OF SCHOOL
  2 23 IMPROVEMENT TECHNOLOGY BLOCK GRANT FUNDS.
  2 24    1.  From the moneys appropriated in section 256D.5,
  2 25 subsection 2, other than the moneys allocated in subsection 2
  2 26 of this section, for each fiscal year in which moneys are
  2 27 appropriated, the amount of moneys allocated to school
  2 28 districts shall be in the proportion that the basic enrollment
  2 29 of a district bears to the sum of the basic enrollments of all
  2 30 school districts in the state for the budget year.  However,
  2 31 except as provided in subsection 6, a district shall not
  2 32 receive less than ten thousand dollars in a fiscal year.  The
  2 33 Iowa braille and sight saving school, the state school for the
  2 34 deaf, and the Price laboratory school at the university of
  2 35 northern Iowa shall annually certify their basic enrollments
  3  1 to the department of education by October 1.  The department
  3  2 of human services shall certify the average student yearly
  3  3 enrollments of the institutions under department of human
  3  4 services control as provided in section 218.1, subsections 1
  3  5 through 3, 5, 7, and 8, to the department of education by
  3  6 October 1.
  3  7    2.  From the moneys appropriated in section 256D.5,
  3  8 subsection 2, for each fiscal year in which moneys are
  3  9 appropriated, the sum of one hundred fifty thousand dollars
  3 10 shall be divided among the area education agencies based upon
  3 11 each area education agency's percentage of the total full=time
  3 12 equivalent elementary and secondary teachers employed in the
  3 13 school districts in this state.  An area education agency may
  3 14 contract with an appropriate accredited institution of higher
  3 15 education in Iowa to provide staff development and training in
  3 16 accordance with section 256D.7.
  3 17    3.  For each year in which an appropriation is made to the
  3 18 school improvement technology block grant program, the
  3 19 department of education shall notify the department of revenue
  3 20 and finance of the amount to be paid to each school district
  3 21 and area education agency based upon the distribution plan set
  3 22 forth for the appropriation made pursuant to this section.
  3 23 The allocation to each school district and area education
  3 24 agency under this section shall be made in one payment on or
  3 25 about October 15 of the fiscal year in which the appropriation
  3 26 is made, taking into consideration the relative budget and
  3 27 cash position of the state resources.
  3 28    4.  Payments made to school districts and area education
  3 29 agencies under this section are miscellaneous income for
  3 30 purposes of chapter 257.  Moneys received under this section
  3 31 shall not be commingled with state aid payments made under
  3 32 sections 257.16 and 257.35 to a school district or area
  3 33 education agency and shall be accounted for by the local
  3 34 school district or area education agency separately from state
  3 35 aid payments.
  4  1    5.  Moneys received under this section shall not be used
  4  2 for payment of any collective bargaining agreement or
  4  3 arbitrator's decision negotiated or awarded under chapter 20.
  4  4    6.  For purposes of this section and section 256D.8,
  4  5 "school district" means a school district, the Iowa braille
  4  6 and sight saving school, the state school for the deaf, the
  4  7 Price laboratory school at the university of northern Iowa,
  4  8 and the institutions under the control of the department of
  4  9 human services as provided in section 218.1, subsections 1
  4 10 through 3, 5, 7, and 8.  However, notwithstanding subsection
  4 11 1, the amount of moneys allocated to the institutions under
  4 12 the control of the department of human services as provided in
  4 13 section 218.1, subsections 1, 2, 3, and 5, shall be a total of
  4 14 not more than twenty thousand dollars for each fiscal year, to
  4 15 be distributed proportionately between the four institutions
  4 16 by the department of education.
  4 17    Sec. 6.  NEW SECTION.  256D.7  SCHOOL IMPROVEMENT
  4 18 TECHNOLOGY PLANNING.
  4 19    1.  Each school district shall include a technology plan as
  4 20 a component of the annual report submitted to the department
  4 21 of education in accordance with section 256.7, subsection 21,
  4 22 paragraphs "a" and "c".  The plan shall be developed by
  4 23 licensed professional staff of the district, including both
  4 24 teachers and administrators.  The plan shall, at a minimum,
  4 25 focus on the attainment of student achievement goals on
  4 26 academic and other core indicators, consider the district's
  4 27 interconnectivity with the Iowa communications network, and
  4 28 demonstrate how the board will utilize technology to improve
  4 29 student achievement.  The technology plan shall be kept on
  4 30 file in the district and a copy of the plan, and any
  4 31 subsequent amendments to the plan, shall be sent to the
  4 32 appropriate area education agency.
  4 33    2.  Prior to receiving funds under this chapter, each area
  4 34 education agency shall develop a plan to assist school
  4 35 districts in the development of a technology planning process
  5  1 to meet the purposes of the school improvement technology
  5  2 block grant program.  The plan shall describe how the area
  5  3 education agency intends to support school districts with
  5  4 instructional technology staff development and training.  The
  5  5 department shall approve each plan prior to the disbursement
  5  6 of funds.  An area education agency needs to develop only one
  5  7 plan and send it to the department of education while this
  5  8 chapter is effective.  An area education agency may submit a
  5  9 plan that meets the requirements of section 256D, Code
  5 10 Supplement 2001.  An annual progress report shall be submitted
  5 11 to the department of education.
  5 12    3.  Prior to receiving funds pursuant to section 256D.5,
  5 13 subsection 2, the Iowa braille and sight saving school, the
  5 14 state school for the deaf, and the Price laboratory school at
  5 15 the university of northern Iowa shall each submit to the state
  5 16 board of regents and the department of education a technology
  5 17 plan that supports and improves student achievement,
  5 18 demonstrates how technology will be utilized to improve
  5 19 student achievement, and includes an evaluation component.
  5 20 The schools listed in this subsection need to develop only one
  5 21 plan each to send to the state board of regents and the
  5 22 department of education while this chapter is effective.  An
  5 23 annual progress report shall be submitted to the state board
  5 24 of regents and the department of education.
  5 25    4.  Prior to receiving funds pursuant to section 256D.5,
  5 26 subsection 2, the institutions under the control of the
  5 27 department of human services as provided in section 218.1,
  5 28 subsections 1 through 3, 5, 7, and 8, shall each submit to the
  5 29 departments of education and human services a technology plan
  5 30 that supports and improves student achievement, demonstrates
  5 31 the manner in which technology will be utilized to improve
  5 32 student achievement, and includes an evaluation component.
  5 33 Each institution developing a plan under this subsection needs
  5 34 to develop only one plan to send to the departments of
  5 35 education and human services while this chapter is effective.
  6  1 Each institution shall submit an annual progress report to the
  6  2 departments of education and human services.
  6  3    Sec. 7.  NEW SECTION.  256D.8  SCHOOL IMPROVEMENT
  6  4 TECHNOLOGY BLOCK GRANT EXPENDITURES.
  6  5    1.  Except as provided in subsection 2, a school district
  6  6 shall expend funds received pursuant to section 256D.5,
  6  7 subsection 2, for the acquisition, lease, lease=purchase,
  6  8 installation, and maintenance of instructional technology
  6  9 equipment, including hardware and software, materials and
  6 10 supplies related to instructional technology, and staff
  6 11 development and training related to instructional technology,
  6 12 and shall establish priorities for the use of the funds.
  6 13 However, funds received by a school district pursuant to
  6 14 section 256D.5, subsection 2, shall not be expended to add a
  6 15 full=time equivalent position or otherwise increase staffing,
  6 16 unless the school district expends not more than ten percent
  6 17 of the funds received to employ or enter into a contract with
  6 18 information technology specialists to provide technical
  6 19 consulting and integration of technology in curriculum and
  6 20 instruction to advance student achievement.
  6 21    2.  A school district may expend up to two=thirds of the
  6 22 funds received annually pursuant to section 256D.5, subsection
  6 23 2, for any of the purposes described in section 256D.2,
  6 24 including for the employment of additional licensed
  6 25 instructional staff.
  6 26    3.  Funds received by an area education agency pursuant to
  6 27 section 256D.6, subsection 2, shall be expended for the costs
  6 28 related to supporting school districts within the area served
  6 29 with technology planning and equipment, including hardware and
  6 30 software, materials and supplies related to instructional
  6 31 technology, employment of or contracting with information
  6 32 technology specialists to provide technical consulting and
  6 33 integration of technology in curriculum and instruction, and
  6 34 staff development and training related to instructional
  6 35 technology.
  7  1    Sec. 8.  Section 256D.9, Code 2003, is amended to read as
  7  2 follows:
  7  3    256D.9  FUTURE REPEAL.
  7  4    This chapter is repealed effective July 1, 2003 2005.
  7  5    Sec. 9.  DIRECTIONS TO THE CODE EDITOR.  The Code editor
  7  6 shall provide historical information to the reader explaining
  7  7 the enactment, repeal, and reenactment of sections 256D.6
  7  8 through 256D.8.
  7  9    Sec. 10.  EFFECTIVE DATE.  This Act, being deemed of
  7 10 immediate importance, takes effect upon enactment.
  7 11                           EXPLANATION
  7 12    This bill reinstates language creating and funding the
  7 13 school improvement technology program, and extends repeal of
  7 14 the Code chapter creating the program to July 1, 2005.  Though
  7 15 the program was amended and combined with the early
  7 16 intervention block grant in 1999, the basic program was in
  7 17 place and funded from FY 1995=1996 through FY 2001=2002.
  7 18    From the $30 million the bill appropriates statutorily for
  7 19 FY 2003=2004 and 2004=2005, area education agencies (AEAs) are
  7 20 allocated $150,000, to be divided among the AEAs based upon
  7 21 each AEA's percentage of the total full=time equivalent
  7 22 elementary and secondary teachers employed in the school
  7 23 districts in this state.  Fifty percent of the moneys are
  7 24 distributed to school districts on a per pupil basis, with the
  7 25 remainder distributed based on the proportion of students
  7 26 enrolled who are eligible to receive free or reduced price
  7 27 meals.  The bill defines "school district" to include the Iowa
  7 28 braille and sight saving school, the Iowa school for the deaf,
  7 29 the Price laboratory school at the university of northern
  7 30 Iowa, and the following institutions under the control of the
  7 31 department of human services:  the state training school, Iowa
  7 32 juvenile home, Glenwood state resource center, Woodward state
  7 33 resource center, and the mental health institutes in Cherokee
  7 34 and Independence.  However, the amount of moneys allocated to
  7 35 the Glenwood state resource center, Woodward state resource
  8  1 center, and the mental health institutes at Cherokee and
  8  2 Independence is limited to a combined total of not more than
  8  3 $20,000 for each fiscal year, to be distributed
  8  4 proportionately between the four institutions.
  8  5    Under the program, each district, school, or institution
  8  6 must submit to the department of education and, as
  8  7 appropriate, the state board of regents or the department of
  8  8 human services, a technology plan that supports and improves
  8  9 student achievement, demonstrates how technology will be
  8 10 utilized to improve student achievement, and includes an
  8 11 evaluation component.  Each AEA must develop a plan to assist
  8 12 school districts with technology planning and instructional
  8 13 technology staff development and training.  An annual progress
  8 14 report must also be submitted.  The bill lists the allowable
  8 15 expenditures of program moneys.
  8 16    The bill permits a school district to expend up to two=
  8 17 thirds of the funds it receives annually under the school
  8 18 improvement technology program for the Iowa early intervention
  8 19 block grant program.
  8 20    The bill directs the Code editor to provide historical
  8 21 information explaining the enactment, repeal, and reenactment
  8 22 of the Code sections creating the school improvement
  8 23 technology program.
  8 24    The bill takes effect upon enactment.
