Senate File 2321 - Enrolled PAG LIN 1 1 SENATE FILE 2321 1 2 1 3 AN ACT 1 4 RELATING TO THE RECYCLING OF MERCURY=CONTAINING LAMPS BY 1 5 PROVIDING FOR A STUDY. 1 6 1 7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 1 8 1 9 Section 1. MERCURY=CONTAINING LAMPS RECYCLING PROGRAM 1 10 STUDY. 1 11 1. The department of natural resources shall conduct a 1 12 study on and make recommendations for the implementation and 1 13 financing of a convenient and effective mercury=containing 1 14 lamp recycling program. The department shall submit a report 1 15 containing the recommendations to the general assembly by 1 16 January 1, 2009. 1 17 2. The department shall consult with stakeholders 1 18 including persons who represent retailers of 1 19 mercury=containing lamps, waste haulers, mercury=containing 1 20 lamp recyclers, mercury=containing lamp manufacturers, cities, 1 21 counties, environmental organizations, public interest 1 22 organizations, and other interested parties that have a role 1 23 or interest in the recycling of mercury=containing lamps. 1 24 3. In conducting the study, the department shall assess 1 25 potential methods for establishing and financing a convenient 1 26 and effective statewide recycling program for 1 27 mercury=containing lamps. The assessment includes but is not 1 28 limited to all of the following: 1 29 a. The recycling challenges unique to rural and urban 1 30 areas. 1 31 b. The involvement of mercury=containing lamp 1 32 manufacturers. 1 33 c. The various methods of financing recycling programs for 1 34 mercury=containing lamps. 1 35 d. The various methods to encourage the return of 2 1 mercury=containing lamps for recycling. 2 2 e. The impact of different recycling approaches on local 2 3 governments, nonprofit organizations, waste haulers, and other 2 4 stakeholders. 2 5 f. The existing recycling infrastructure that could be 2 6 used for mercury=containing lamp recycling. 2 7 g. Information obtained from existing mercury=containing 2 8 lamp recycling programs. 2 9 4. The department shall also describe in the report what 2 10 improvements could be achieved through voluntary efforts by 2 11 stakeholders and what efforts would require legislation or the 2 12 adoption of rules to implement a statewide recycling program 2 13 for mercury=containing lamps. 2 14 2 15 2 16 2 17 JOHN P.
